The Privacy
Commissioner for Personal Data is an independent office established by
the Personal Data (Privacy) Ordinance (“the Ordinance”) to enforce and
promote compliance with its requirements. Applications are now
invited for the following posts in the Privacy Commissioner's Office
(PCPD): -
(A)
Senior Personal Data Officer
Remuneration
Basic salary of $50,475 per month plus a monthly
cash allowance of $7,845.
Requirements
a)
|
|
A recognised degree,
preferably in law, social science or accounting, from a university in
Hong Kong, or equivalent;
|
| b) |
|
Solid experience in
complaint investigation, legal practice, data system inspection,
process control compliance audit, and /or security risk assessment; |
| c) |
|
A minimum of 8 years
relevant working experience of which 2 years are in the capacity as a
team leader or supervisor, preferably gained in regulatory or law
enforcement agencies, legal firms, audit consultancy firms or
international corporations; |
| d) |
|
Strong analytical,
drafting and inter-personal skills with a mature personality; |
| e) |
|
Knowledge of the
requirements of the Ordinance or personal data privacy matters
preferable; |
| f) |
|
Excellent command of both
written and spoken English and Chinese. |
Major Duties
a)
|
|
To supervise the team’s
work in handling public complaints of alleged contraventions of
requirements under the Ordinance;
|
| b) |
|
To undertake
investigation of suspected contraventions of requirements
under the Ordinance, including gathering and analysis of information
and evidence, preparation of investigation results and cases for
prosecution of offenders; |
| c) |
|
To undertake and
participate in projects and compliance audits relating to personal data
privacy. |
Terms and Conditions
Senior Personal Data
Officer is a permanent post of the PCPD establishment. The
successful candidate will be offered a contract for 3 years with
gratuity of 15% of the basic salaries received over the agreement
period upon satisfactory completion of the agreement.

(B) Legal Counsel
Remuneration
Basic monthly salary
ranges from $66,060 to $77,675 plus a monthly cash allowance of $8,905,
contract-end gratuity and other fringe benefits.
Requirements
a)

A bachelor’s degree in
law from a Hong Kong university, or equivalent;
|
| b) |
|
Solicitor
or barrister in a recognized jurisdiction as stipulated under the Legal
Officers Ordinance;
|
| c) |
|
A
minimum of 4 years’ post-admission or post-call professional experience;
|
| d) |
|
Excellent
command of oral and written Chinese and English;
|
| e) |
|
Experience
in litigation work (preferably criminal prosecution) will be an
advantage;
|
f)
|
|
An independent and team
worker. |
Duties
Working under the
supervision of the Chief Legal Counsel, the
Legal Counsel will: -
- provide advice and
support on legal matters related to the interpretation and
implementation of the Ordinance;
- handle appeals lodged
with the Administrative Appeals Board (AAB);
- assist the preparation of
guidance materials, guidelines and codes of practice;
- advise on legal aspects
of complaints received by the Office and investigations and inspections
undertaken by the Office;
- undertake legal
researches in relation to data protection laws and practice in other
jurisdictions; and
- provide general legal
support for the operation of the PCPD.
(C)
Legal Executive
Remuneration
Salary at $18,885 per
month plus fringe benefits.
Requirements
a)

A Diploma or a
Certificate in Legal Studies; |
| b) |
|
Minimum
2 years’ relevant experience as a legal executive engaging in
litigation work;
|
| c) |
|
Proficiency
in Chinese and English.
|
Duties
The Legal Executive will:
-
- assist Legal Counsel in
handling appeals lodged with Administrative Appeals Board (AAB);
- handle legal procedures
including service and filing of documents;
- assist drafting case
notes on AAB decisions;
- monitor new judgments
made by Hong Kong courts and overseas development in privacy
protection; and
- assist in carrying out
legal researches in relation to data protection laws and practice in
other jurisdictions.
Terms and Conditions
Post (B) is a permanent
post of the PCPD establishment. The
successful candidate will be offered a contract for 2 years with
gratuity of 15% of the basic salaries received over the agreement
period upon satisfactory completion of the agreement.
Post (C) is a
non-permanent post of the PCPD establishment. The
successful candidate will be offered a contract for 12 months.
