ABOUT THE PRIVACY COMMISSIONER'S OFFICE

Personal Data (Privacy) Advisory Committee

Section 11 (1) of the Ordinance provides for the establishment of the Personal Data (Privacy) Advisory Committee to advise the Privacy Commissioner on matters relevant to the privacy of individuals in relation to personal data or other matters relevant to the implementation of the Ordinance. The Secretary for Home Affairs appoints the Members of the Personal Data (Privacy) Advisory Committee which is chaired by the Privacy Commissioner.

In October 2003, the Secretary for Home Affairs appointed the following persons to be members of the Committee for a period of two years with effect from 1 October 2003:

*The appointment of Ms. Ko took effect from 1 June 2004.

During the period under review, the Committee met for the nineteenth and twentieth time.

At the nineteenth meeting of the Committee, held on 18th June 2004, members were updated on the PCPD's participation in the APEC Privacy Framework initiative and informed of the key findings of the 2004 Opinion Survey on Attitudes Towards and Implementation of the Personal Data (Privacy) Ordinance. At the twentieth meeting of the Committee held on 22nd November 2004, members were informed of the details of the Privacy Guidelines: Monitoring and Personal Data Privacy at Work and the efforts of the PCPD in conducting sample checks against blind recruitment advertisements.

Copies of all agenda papers and minutes of meetings of the Personal Data (Privacy) Advisory Committee are available on request subject to the payment of a small fee to cover photocopying costs.

Staff and Organizational Structure

The PCPD is headed by the Privacy Commissioner for Personal Data ("the Privacy Commissioner") who has overall responsibility for promoting, monitoring and supervising compliance with the Ordinance and administering the activities of the PCPD. A Deputy Privacy Commissioner for Personal Data assists the Privacy Commissioner in the overall administration and strategic planning of the PCPD. He also has responsibility for policy issues relating to personal data privacy.

The Office had a total establishment of 39 staff at the end of the period under review and was organized in 5 divisions:
