Judicial
Review lodged with the High Court
Under administrative
law, an aggrieved party may make an application for Judicial Review to
the Court against the decision made by the Privacy Commissioner in refusing
to carry out an investigation of his complaint. During the reporting period,
there was an application for Judicial Review made to the Court by a complainant
against the Privacy Commissioner's decision made under section 39(2)(c)
of the PD(P)O in refusing to carry out an investigation of his complaint
on the ground that the complaint was frivolous or vexatious or was not
made in good faith. At the end of the reporting period, the case was part
heard.
